Terms and Conditions

1. Agreement to Terms

By accessing or using the Silent Auction platform operated by BAMWX LLC for the benefit of Funkcancer Foundation Inc., you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this platform.

2. Eligibility

To participate in this silent auction, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Have a valid payment method on file

3. Registration and Account

When you register for the auction, you will receive a unique paddle number. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Bidding Rules

By placing a bid, you agree to the following:

• All bids are final and binding commitments to purchase the item at the bid price if you are the winning bidder
• Bids must meet or exceed the minimum bid amount and bid increment specified for each item
• You may not retract or cancel a bid once placed
• The highest bid at the close of the auction wins the item
• In the event of a tie, the bid placed first will be the winning bid
• Age-restricted items (21+): Items marked 21+ may only be bid on by bidders who are at least 21 years of age. Valid government-issued photo ID confirming age 21+ is required at the time of pickup or delivery (adult signature required for shipped 21+ items). If you cannot prove you are 21 or older, your winning bid for that item will be forfeited and the item will not be released to you.
• Fulfillment: Items may be shipped to a U.S. address or picked up in person by arrangement with the organizers — see Section 8.

5. Auto-Bidding (Max Bid)

The auto-bid feature allows you to set a maximum amount you are willing to pay for an item. The system will automatically place bids on your behalf up to your maximum amount. By using this feature, you authorize the system to bid on your behalf and agree to honor any resulting winning bid up to your specified maximum.

6. Payment Terms

By registering to bid, you authorize Funkcancer Foundation Inc. to charge your payment method for any winning bids. Charges will appear on your statement from Funkcancer Foundation Inc. Payment will be processed at the conclusion of the auction. All sales are final. Credit card processing fees may apply as indicated during checkout.

7. Item Descriptions and Condition

All items are sold "as-is" without warranty of any kind. Item descriptions are provided for informational purposes and may not be complete. Retail values are estimates only. We are not responsible for any errors or omissions in item descriptions.

8. Item Fulfillment

Winning items will be fulfilled by one of the following methods, coordinated with the organizers after the auction closes:

• Shipping: Items can be shipped to a U.S. address provided after the auction. Shipping fees (if any) will be communicated by the organizers and may be added to your charge. For items marked 21+, adult signature confirming age 21+ is required at delivery; if delivery cannot be completed, the bidder remains responsible for the winning bid.
• In-person pickup: Items may be picked up in person by arrangement with the organizers. For items marked 21+, valid government-issued photo ID confirming age 21+ must be presented at pickup. Items will not be released to anyone who cannot prove they are 21+.

Items that cannot be fulfilled (e.g., refused delivery, repeated delivery failures, or no response from the winner) may be forfeited at the sole discretion of the organizers. Forfeited items do not entitle the bidder to a refund of any portion of the bid that has already been authorized or charged.

9. Charitable Nature

This is a charitable auction benefiting Funkcancer Foundation Inc. The difference between your winning bid and the fair market value of the item may be tax-deductible. Please consult with your tax advisor for specific guidance.

10. Prohibited Conduct

You agree not to:

• Place bids you do not intend to honor
• Interfere with or manipulate the bidding process
• Create multiple accounts to circumvent bidding rules
• Use automated systems to place bids (except our auto-bid feature)
• Violate any applicable laws or regulations

11. Limitation of Liability

BAMWX LLC and Funkcancer Foundation Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this platform or participation in the auction. Our total liability shall not exceed the amount of your winning bids.

12. Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this platform. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions.
